Magistrate Pa Harry Jammeh of the Kanifing Magistrates’ Court, yesterday delivered the verdict in a protracted case involving Tabara Samba, by sentencing her to death. Tabara Samba, aged, 42, who was standing trial for the past six months was found guilty of murdering, Ebrima Nyan, her husband in the month of March, 2007, by pouring hot oil on him while sleeping, in Old Jeshwang. Delivering his two-hour judgment in a crowded court room, Magistrate Jammeh, told the accused that, “what she did was shocking, incomprehensible, distressing, unloving and unimaginable”.
He said “in you, I see a deceptive personality and a woman who personifies evil. A woman who is every man’s nightmare and a disgrace to her counterparts and culture”, said Magistrate Jammeh.
Magistrate Jammeh further told Tabara Samba that the act of pouring hot oil on somebody is violence.
According to him, he was convinced that the prosecution has proven their case beyond reasonable doubt and that it was the intention of Tabara Samba to cause serious bodily harm to her late husband, Ebrima Nyan, thus leading to his untimely death.
Magistrate Jammeh further recalled that the accused in her evidence told the court that she started cooking at a very early age. Therefore, Magistrate Jammeh said “every woman knows how serious and dangerous a hot oil is “.
Counsel Amie Joof- Conteh, in her plea of mitigation, urged the court to temper justice with mercy. “No marriage, no wife or no husband is perfect. Tabara has shown remorse of her actions”, Counsel Amie Joof-Conteh stated.
However, Magistrate Jammeh finally convicted and sentenced Tabara Samba to death for killing his late husband by pouring hot oil on him.
After the final verdict was delivered in court, Tabara Samba, was seen in a relax mood, while waiting to be taken to the State Central Prisons, Mile ll.
Among the crowd in the court room was Benedict Jammeh, Inspector General of Police (IGP).
