Accused Person Acquitted, Discharged

Bundung Magistrates’ Court presided by Principal Magistrate Kumba Sillah Camara earlier this month, has acquitted one Abdoulie Bah to go scot-free from all charges of being in possession of fake bank notes.

Magistrate Kumba Sillah Camara ruled that the accused was exonerated after prosecution failed to prove their case beyond reasonable doubt coupled with inconsistency marked in the evidences adduced by prosecution witnesses. She further adjudged that prosecution witness number two’s testimony was based on hearsay.

In the circumstances the burden of proof lies on the prosecution to prove their case beyond all reasonable doubt, and convince the court to convict the alleged. Since none of prosecution witnesses testified that the accused was found in possession with the fake bank notes, the accused was accordingly acquitted and discharged by the court.

The particulars of the charge stated that on the 25th May 2008, at Latrikunda Sabiji the accused Abdou Bah was alleged to be found with $1300 fake United States Dollars, charges which he denied.
