An Italian National Case, Prosecution Given Ultimatum

As the trial of the Italian National Domenico Fedeli dragged on, the court issued an ultimatum to the prosecution with regard to the case on Thursday.

According to Magistrate Kayode, the presiding Magistrate in the case, the court would grant the request for an adjournment of the case for the last time for the prosecution to assemble witnesses.

He added that the prosecution is further informed that if they fail to proceed with the case on the next adjourned date, the case would be struck out for want of diligent prosecution and the accused would be consequently discharged.

The prosecution earlier on applied for the case to be adjourned to enable the preparation of their case.

The defence counsel Lawyer Haddy Njie stated that the defence would concede for the last opportunity as requested by the prosecution.

It will be recalled that the Italian National Domenico Fedeli is standing trial before the Banjul Magistrates’ Court for the offence of stealing contrary to section 252 of criminal code of the laws of The Gambia.

The alleged offence revealed that Domenico Fedeli on or about the 10th January 2008 at the licensing department police headquarters, in the city of Banjul in the republic of The Gambia stole a motor vehicle with Registration number BJL 4063B Mark S. Sanyong Korando 290 SR without permission or lawful authority being the property of Kanilai family farm.

He has since vehemently denied the allegation preferred against him, before being granted court bail in the sum of D250,000 with file deeds.
