According to the particulars of claim, the Plaintiff, Faye Fofana, is asking the defendant, Sarang Sillah, to refund her US$2000 and D3000 being monies given to him for the processing of an American visa for the Plaintiff ’s son which the defendant failed to do and also refused to pay to the plaintiff the US$2000 and D3000.
In his ruling, Magistrate Mbake told the court that the defendant had been absent for three sessions without notifying the court the reason for his absence.
In the circumstances, he said, the court deemed it fit to rely on section 7 of the Subordinate Courts Civil Proceedings Act to give judgement in favour of the plaintiff for the sum of US$2000 plus D3000.
Magistrate Mbake ordered the defendant to pay the said monies within 14 days
