Milly’s Night Club Case Opens

Andrew Gomez who dragged Milly’s Night Club to court on Wednesday 4th February, testified before acting Principal Magistrate Sainabou Wadda-Ceesay of the Kanifing Magistrates’ Court.

In his testimony, Mr Gomez told the court that he was a DJ and knew the defendant. He stated that he had an agreement with the defendant to have a program on the 29th November 2008. He noted that he was supposed to organise a commercial dance on a share base.

Mr Gomez further narrated that after the programme they would share the profit and that he would share the profit by taking 40% of it while the defendant would receive 60%. He adduced that one Pa Modou Secka commonly known as Rati, who is also a DJ at the defendant’s club has all contracts for musicians. He revealed that Rati would take 25% from his share of 40% and that Rati told the Manager of the club, Yusupha Sowe, that everything was settled for Andrew Gomez’s programme for the 29th November 2008.

The plaintiff adduced further that on the day of the programme he went to the club and found Gamcel having a programme there. He stated that he had told the manager that he should have performed rather than Gamcel but the manager told him that he had no idea that Gamcel was performing on that day. Mr Gomez narrated that he told the manager that Gamcel should finish at 12 midnight because his people were coming for his programme, and that some of them went home after 1am because he could not perform his programme.

He further said that the manager told him that D2,132 was the proceeds of the tickets sold for his programme and was given D900 as his share. He added that he asked for the Gamcel money but the manager told him that he should not be given anything from the proceeds. He said he spent D3000 for other expenses and the manager was informed accordingly, but he was asked to go out of the club by the manager.

The case was adjourned to the 17th February 2009 for continuation.
