In Musa Suso trial Magistrate urged to excuse himself

Sunday, March 15, 2009
Lamin Jobarteh, counsel for the embattled Musa Suso, last Friday told Senior Magistrate Kayode Olajubutu of the Banjul Magistrates Court that he and his client have no confidence in him and for that matter are  asking him to excuse himself from the case.

“We are not comfortable with the matter being continued in this  court,” said the defence counsel. Musa Suso  is standing trial on multiple counts of giving false information to a public officer. At last Friday’s sitting, Lamin Jobarteh forwarded reasons for the defense’s lack of confidence in the proceedings of the trial before Kayode Olajubutu.

He hinted that he and his client (Musa Suso) doubt that the court  can accord them fair and impartial hearing, the inability to prepare their defence due to lack of access to the required documents which are in the possession of the prosecution despite notice for the prosescution to make the said documents availabe to the defense and the unprecedented commencement of proceedings  despite the absence of the counsel for the accused.

The presiding magistrate later adjourned the case to 20th March to rule on the submission of the defence counsel.
