Court Orders Must be Obeyed - Magistrate Mbake

Senior Magistrate Abdoulie Mbake of the Kanifing Magistrates’ Court yesterday proclaimed that court orders must be obeyed.

He made the pronouncement after Lawyer Edu Gomez told the court that his client, one Modou Manga, charged with stealing was being incarcerated at Mile 2 prison arbitrarily. Hence he applied to the court for his release.

Magistrate Mbake told the court that there is only one law in the country, positing that where the first magistrate set a bail condition, it should be adhered to the letter.

He noted that it was wrong to detain the accused arbitrarily.

He maintained that he would not revoke the bail condition by Magistrate Jawo (former) and added that the order of the court must be obeyed.

In his submission, Lawyer Gomez stated that the accused was granted a court bail some seven months ago.

He revealed that by the records of the court, at the start of proceedings, ASP Bojang, who was then prosecuting the case, made a very strong application before Magistrate Jawo, requesting that the bail condition of the accused be revoked or made strict or severe.

He further adduced that no other reasons were given for the continued detention of his client.

He submitted that Magistrate Jawo ruled that the bail condition to the accused should continue.

He added that not withstanding that ruling the accused was directly taken to Mile 2 where he still continued to be detained for reasons beyond his understanding.
